DUI 第21章 Traveling to Canada [DUI]
DUIのお話の続きです。
D.U.I.とはDriving under the influenceの略、日本風に言えば酔っ払い運転のこと。。。。
今回のBlogはちょっといつもとは違って文字ばかりのBlogになります。

今回はカナダのDUIについてのお話です。
アメリカのお隣りの国、カナダでも飲酒運転(DUI)は犯罪になります。
アメリカと同じくBAC(blood alcohol concentration)が0.08以上の運転で逮捕となり
最低でも$1000以上の罰金、1年以上の免許停止となるようです。
そしてカナダはさらにアメリカよりもDUIに対して大変厳しい姿勢をとっており
他に他に事故等が絡まなくても即Felony(重罪)扱いとなるとのこと。
→アメリカは事故等がなければmisdemeanor(軽犯罪)
さらにDUIで捕まったカナダ国籍以外の人はカナダには入国できない可能性が高いのだそうです。
→飲酒運転のみで他に事故等がない場合でも同じ。
さらにアメリカとカナダはこの犯罪関連の情報を共有しているそうで
カナダ国内のみならずアメリカ国内でDUIで逮捕された人も同様とか。
アメリカとカナダの国境は陸路でも渡ることができます。
逮捕歴のない人はパスポートを見せるのみですんなり通過することができるようです。
カナダ入国の審査はアメリカと比べるとかなり甘いと言われています。
ただカナダの入国審査官はパスポート情報から、
アメリカおよびカナダでの過去の犯罪履歴のデータベースにアクセスする事が可能で
その際、DUI歴がHitすると入国拒否となる可能性が高いのだそうです。
いろいろ調べてみると、
DUI歴のある人はカナダへの入国は考え直したほうがいいと述べているのがほとんどで
過去にDUIを犯した人がカナダに入国できたという話も中にはありましたが、
だからと言って、DUIを犯した人が必ず入国できるとは限りません。
アメリカ入国の際も、アメリカの入国審査官が私のパスポート情報から
私のDUI歴がわかり、別室に連れていかれて、詳細審査をさせられていますから、
今の状態でカナダに入国したら、入国拒否となる可能性のほうが高いでしょうね。
さらにカナダでの入国審査の際は、入国審査官が質問する、しないにかかわらず、
犯罪歴は申告しなければならず、仮に申告しないで入国してしまい、何らかの形でばれると
それはそれでもっと重い罪に問われるとのこと。
上の写真はナイアガラの滝の近くにあるレインボーブリッジと呼ばれるカナダとアメリカを結ぶ橋。
この橋は車はもちろんのこと、歩いて渡ることもできます。
本当に入国拒否されるのか？！
いざ挑戦！！！
なんてことはしておりません(^^;
以上がナイアガラの滝でカナダ側に宿泊しなかった理由となるわけです(^^;→その記事
では、もう2度とカナダに入国できなくなってしまうのか？
実はそういうわけではなく、入国できる方法が幾つかあるのだそうです。
詳細はこちらのHP(英文)を参照してほしいのですが、
簡単に書くと。。。（ちなみにこれはアメリカ人向けに書かれたもののようです）
Option #1
犯罪を犯してから最低でも10年以上経過している上で、規定の書類を揃えカナダの入国管理事務所に申請し、承認を得る→Deemed Rehabilitation.
Option #2
犯罪を犯してから最低でも5年以上経過している上で、規定の書類及び申請料を揃えカナダの入国管理事務所に申請し、承認を得る→ Streamlined Rehabilitation.
Option #3
Option #1,2でNGの場合、、、、
規定の書類及び申請料を揃えカナダ大使館に申請し、承認を得る→ Approval of Rehabilitation
Option #4
Option #1,2, 3でNGの場合、、、、
特別な入国許可証をカナダの移民局に発行してもらう。→Temporary Resident Permit
これらの手続きも複雑でなかなか個人でやるのは難しいと思われ、弁護士にお願いするのが無難かと思われます。

かの元大統領もDUIの経歴があり、カナダ入国の際、いろいろと大変だったそうです。。。。

国境検査がないヨーロッパのシェンゲンからは想像もできないことですねえ。
データをそんなに共有しているなら、アメリカでもうOKとなったものに対してはそのデータも共有すればいいのに、という気がするのに、難しいものですね。

アメリカ映画のシーンには、
よく一杯引っかけて車を運転して帰るものが
多いのですが、どうなんでしょう？
パーティのシーンでもよく見かけますが・・・・。
現場時代の若い頃、
一度検問に引っかかりましたが、
家に近かったこともあり、
注意して帰りなさい、と親切なおまわりさんに言われました。
35年も前ですから、
人間そのものが穏やかだったのでしょうか？

すごい厳しさに驚きましたが、飲酒運転撲滅のためには、これくらいの厳罰はしかたないかもしれないですね。
それより、日本は甘すぎると思います。
未だに飲酒運転で人身事故のニュースは多いですから。

日本も、飲酒運転に厳しくなり、ゴルフのコンペのプレー後、昔は、軽くビールを一杯飲みましたが、今は、全く飲みませんね。ノンアルコールビールを飲むくらいですね。

実はBACが0.08以上というのがミソでして、これは一般男性が350mlのビールを2，3杯飲むと達するくらいの値だそうです。ですのでビール1杯くらいですと数値上違法にならないということになるんです。詳細はこちらの記事で書いてますので興味あればご覧下さいね。
